Massachusetts
Massachusetts has some of the strongest tenant protections in the country, especially around security deposits and habitability.
What this means
- Security deposits are tightly regulated — capped at one month's rent, must be held in a separate interest-bearing account in a Massachusetts bank, and require specific receipts and statements of condition.
- Landlords generally must maintain rental units to the State Sanitary Code, and renters have well-established rights to repair-and-deduct or withhold rent in specific circumstances.
- Evictions ('summary process') follow a formal court procedure. Self-help evictions — lockouts, utility shutoffs, removing belongings — are prohibited.
Things to pay extra attention to
A landlord's failure to follow the deposit statute exactly can have real consequences at move-out. Save every receipt, statement of condition, and interest notice.
These are two different things under Massachusetts law and are handled separately. Confirm in writing which the landlord is collecting.
Notice to quit, notice to cure, and notice of non-renewal each have specific requirements. Put everything in writing and keep dated copies.
